ACCION URGENTE: 16 militantes sociales de procesos del Congreso de los Pueblos fueron perseguidxs y detenidxs ilegitimamente. Los medios de comunicación y el Gobierno han violentado sus derechos básicos.
ANTE FALSOS POSITIVOS JUDICIALES
COMUNICADO DE PRENSA DEL CONGRESO DE LOS PUEBLOS

Bogotá, Colombia. 8 de julio de 2015. El Congreso de los Pueblos y organizaciones de derechos humanos denunciamos y rechazamos ante la comunidad nacional e internacional los hechos en los que han sido detenidos, bajo la modalidad de falsos positivos judiciales, 16 personas, integrantes de procesos sociales, estudiantiles, periodistas, entre otras.
En este momento en el que se abren más posibilidades hacia la paz, representados en los anuncios de cese al fuego que le dan más confianza al proceso, se desata nuevamente la persecución y estigmatización al movimiento social el cual viene reclamando constantemente garantías al ejercicio de su actividad social y política.
El país ha conocido el sistemático montaje judicial contra líderes de procesos sociales. Tales falsos positivos judiciales han arrojado la interposición de 13 mil demandas administrativas por errores judiciales, esto ha comprometido aproximadamente 27 billones del presupuesto general de la nación. Así por ejemplo, entre 2009 al 2012, 8.600 personas se les vinculó a procesos por supuesta vinculaciones con la insurgencia, de ellas sólo 2058 personas permanecen privadas de la libertad y en consecuencia más del 75% de los capturados fueron declarados inocentes.
Exigimos garantías al debido proceso de las personas detenidas el día de hoy 08 de julio de 2015, toda vez que los medios de comunicación y el alto gobierno, desconociendo la presunción de inocencia, ya han emitido una condena anticipada al imputarles públicamente su pertenencia a organizaciones insurgentes, con ello violan el principio de independencia judicial y debido proceso al que tienen derecho.
Exigimos al gobierno Nacional garantías para la participación política, pues es inconcebible que mediante asesinatos, amenazas y detenciones arbitrarias se pretenda acallar la voz del movimiento social en Colombia.
IN RESPONSE TO THE JUDICIAL FALSE POSITIVES

Bogotá, Colombia. July 8, 2015. The People’s Congress (Congreso de los Pueblos) and its human rights organizations denounce and reject, to the national and international community, the detentions of 16 people, in the form of judicial false positives. These 16 people were members of student groups, social organizations, and were journalists, amongst others.
In this moment when there are more possibilities for peace, represented in the announcements of cease fires that have given more confidence to this process, there is renewed persecution and stigmatization to the social movement which has been demanding guarantees for their social and political activities.
The country has seen a systematic legal fraudulent campaign against leaders of social organizations. These judicial false positives have caused the filing of 13,000 administrative lawsuits for judicial errors, which has already spent about 27 billion COP of the general budget of the country. For example, between 2009 and 2012, 8,600 people were accused of having ties to the insurgency, of these 8,600 only 2,058 people remain incarcerated and more than 75% of the people arrested were declared innocent.
We demand guarantees to the due legal process of the people detained today July 8, 2015, keeping in mind that the media and the high government officials have not recognized the presumption of innocence. They have already given an anticipated sentence by publicly accusing them of belonging to insurgent organizations, and in doing this they violate the principle of judicial independence and due process which they have a right to.
We demand that the National Government give guarantees for political participation. It is inconceivable that by killings, threats and arbitrary arrests, they intended to silence the voice of social movement in Colombia.
